The new battery law (BattG) which is coming into effect on December 1st, 2009 is the directive of the European Parliament and Council regarding batteries and accumulators as well as used batteries and used accumulators.
Core of the implementation of the directive to national law is the law regarding the placing on the market, the taking back and the environmentally friendly disposal of batteries and accumulators (battery law - BattG). Among others it prescribes binding rates for taking back and limit values for the use of cadmium and mercury in batteries and obliges the manufacturers and importers acting on the German market to identify themselves towards a national register of manufacturers (under www.umweltbundesamt.de) so that they are allowed to market batteries and accumulators further on.
The manufacturers of batteries for devices need to make sure that they follow the obligation to take back and recycle the batteries and accumulators and that they establish a mutual non profit-oriented and area-wide acting system to take back used batteries for devices (common collection and recycling system) and that they participate in this system.
Among other things, the common collection and recycling system has to be offered to all suppliers of device batteries, to all public and private waste disposal and processing organizations which offer to collect used abtteries of devices free of charge and to make available appropriate transport containers to the associated organizations which take back the batteries free of charge.
The manufacturers leaving the common collection and recycling system have to inform the authorities immediately and have to establish a system to take back batteries organized by the manufacturer.
The manufacturer is obliged to tag the batteries before the first placing on the market with the icon representing a crossed out waste bin. If the fractions of mercury, cadmium and lead are exceeding the prescribed threshold values, the battery law (BattG) further prescribes to note these information by signs on the batteries. Moreover, the supplier of batteries and accumulators is obliged to point out to their customers by well visible and readable written information and plates,
1. that the batteries can be returned free of charge to the sales outlet after use
2. that the end user is obliged by law to return the used batteries and
3. about the icons/ the signs on the batteries.
