New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Import control of electrical appliances and batteries in Spain

Since 16 January 2023, importers have been required to enter the registration numbers from the WEEE and batteries register into the joint system of customs and SOIVRE before importing their electrical equipment and batteries from third countries into Spain. This ensures an automatic check that detects the absence of a registration in any case. In addition, conformity with ROHS must be proven by documentation accompanying the product. Only after confirmation of conformity by SOIVRE may customs proceed with the release for free circulation.

The Decree adopting control measures for imports of electrical and electronic equipment, batteries and accumulators from third countries took effect in Spain on 16 January 2023. This decree significantly strengthens the competence of the control body SOIVRE and also introduces a system that automates the verification of documents and registration numbers.

The application to SOIVRE by entering the registration number and the relevant documents should therefore be submitted with sufficient time before customs clearance. Products with missing or incorrect markings will also not be released by SOIVRE. Initially, SOIVRE focuses on products that reach Spain by sea. However, an extension of the control by SOIVRE to other traffic routes will probably follow.
