Start of the new legal situation
- The new European Batteries Regulation (BattR) came into force on 18 August 2025. Further information can be found here.
- With the German Battery Implementation Act (BattDG), which came into force on 7 October 2025, the national legal framework is now complete, as you can see from the latest newsletter and press release from the EAR.
Organisation for producer responsibility
- In future, battery producers will have to participate in a producer responsibility organisation (OfH). As you can see in the list of approved OfHs on the EAR Foundation website, there are currently no approved OfHs available. take-e-way is working intensively on solutions for your participation in an OfH and will inform it’s customers as soon as participation in an OfH is possible. For further information and support, please contact the take-e-way consulting team via +49/40/750687-0 or consulting@take-e-way.de.
5 instead of 3 battery categories
In future, producers must register the following battery categories:
- Portable battery
- Starting, lighting and ignition battery (SLI battery)
- Light means of transport battery (LMT battery)
- Electric vehicle battery
- Industrial battery
take-e-way will be happy to help you classifying your batteries correctly.
Industrial batteries are divided into three categories:
- Industrial batteries
- Electric vehicle batteries
- Batteries for light vehicles – so-called LMT (light means of transport battery)
