On 23 September 2025, EU Environment Commissioner Jessika Roswall proposed a one-year postponement of the date of application. Among other things, this was justified by unexpectedly high data traffic in the EU information system TRACES.
On 21 October 2025, the European Commission published draft amendment COM(2025) 652. Contrary to expectations, this does not contain a proposal for a further postponement of the date of application, but rather various simplifications. According to this, the date of application of the EU Deforestation Regulation remains 31 December 2025, as originally planned.
A postponement is only to apply to micro and small market participants. For these market participants, the draft amendment proposes a later start date of 30 December 2026 instead of 30 June 2026. The proposal also provides for new roles and exemptions in the due diligence process for downstream market participants and sellers, among others.
No postponements or simplifications are planned for medium-sized and large market participants. Nevertheless, a six-month transition period has been proposed with regard to controls, during which the authorities can only issue warnings and recommendations. The proposal must now be discussed and adopted by the European Parliament and the European Council by the end of 2025. It remains to be seen whether this will happen in time. At the same time, the Commission is working on contingency plans. Affected market participants and sellers should take appropriate precautions and prepare for the EUDR.
