WEEE registration for heat pumps

Heat pumps fall within the scope of the ElektroG as "heat transmitters that can be used in private households". Sales bans, skimming of profits and fines of over 100,000 euros can be the consequences of unregistered sales.

As take-e-way has learnt from involved parties, sellers and producers of heat pumps are currently increasingly being asked to register their devices with the EAR Foundation according to the German WEEE conversion, the Electrical and Electronic Equipment Act (ElektroG). Until recently, it was generally assumed that heat pumps were not within the scope of the ElektroG. Producers often argued that the devices were permanently installed and therefore not subject to WEEE registration.

It is worth taking a look at the device categorisation on the EAR Foundation website. If you enter the term “Wärmepumpe” (heat pump) there, the result is that heat pumps fall within the scope of application as “Wärmeüberträger, die in privaten Haushalten genutzt werden können” (heat transmitters that can be used in private households).

Producers and sellers of heat pumps who have not yet registered their devices with the EAR Foundation should act as quickly as possible, because in addition to sales bans or the skimming off of profits made from illegal sales, the fines under the ElektroG may exceed 100,000 euros.
