Guidelines on the EU Packaging Regulation for retailers and producers

The European Commission is continuing to drive forward the implementation of the PPWR and has published a comprehensive guidance document on the interpretation of the new requirements. In addition, a dynamically updated ‘living document’ containing frequently asked questions (FAQs) is planned, which is intended to provide companies and authorities with ongoing practical clarity.

The European Commission aims to clarify key definitions, use cases and direct impacts on product design, packaging strategies and compliance processes through clear guidelines. Among other things, the focus is on defining what legally constitutes packaging, including practical borderline cases such as plant pots with plants, as well as the classification of sales packaging that also fulfils transport functions. The latter is of particular importance with regard to the reusable packaging obligations under Article 29. Furthermore, the guidelines provide important guidance on the reuse of reusable containers (kegs) and transport packaging in international trade, which presents new opportunities for export-oriented manufacturers, but also necessitates adjustments.

Furthermore, the interaction between the PPWR and the Single-Use Plastics Directive (SUPD) is explained, which may result in additional regulatory requirements. Similarly, the terms ‘manufacturer’ and ‘producer’ are defined more clearly, which is a crucial point for the allocation of responsibilities along the supply chain. This content is supplemented by specific guidance on bans on certain single-use plastic packaging, for example in the catering sector.

For manufacturers, this guide is therefore intended not only to provide legal guidance but also to serve as a strategic basis for adapting packaging solutions to new EU requirements at an early stage and securing competitive advantages in an increasingly circular economy.
