Packaging: How do I deal with left-over stock?

The PPWR came into force on 12 August 2026, but there are exceptions for packaging already on the market. Left-over packaging that was supplied before this date can usually still be sold. The new PPWR rules only apply to packaging placed on the EU market after that.

The new PPWR requirements do not apply retroactively, and there is no specific sell-off period. This means retailers can continue to sell their stock even after 12 August 2026. Packaging that was already produced but not delivered before the cut-off date does not automatically need to be destroyed, changed or relabelled. Depending on the circumstances, missing labelling details may be provided in accompanying documents.

For packaging that was not yet on the EU market by 12 August, the situation is different: it must meet all necessary PPWR requirements that applied from that date.

One question, however, remains unanswered: what evidence will companies need to provide to market surveillance authorities for already existing stock? The European Commission is expected to clarify this in an updated FAQ.
