FAQ Producer Responsibility Organisation (OfH) for Batteries

A PRO (resp. OfH – “Organisation für Herstellerverantwortung”) assumes the legal obligations of battery producers, sellers and importers within the framework of Extended Producer Responsibility (EPR). This includes take-back, disposal, recycling and reporting duties. 

Participation is mandatory as of 15 January 2026. By then, participation must be proven to the EAR Foundation (German registration board for electronic equipment and batteries). 

All companies that sell batteries on the German market must participate.

Participation is mandatory for all battery categories:

• electric vehicle batteries
• light means of transport batteries (LMT battery),
• starting, lighting and ignition batteries (SLI battery),
• industrial batteries
• portable batteries

Anyone who does not provide valid proof of participation in an OfH (PRO) by 15 January 2026 risks having their EAR registration revoked. Further distribution of batteries in Germany will then no longer be permitted. 

The OfH (PRO) obligation arises from the Battery Implementation Act (BattDG – “Batterierecht-Durchführungsgesetz”) which came into effect on 7 October 2025. It replaces the previous Batteries Act (BattG).

• registration 

• quantity declaration  

• proper recycling/disposal

• charging related recycling contribution  

• finding and arranging for a suitable organisation for you

No. If you are already registered with take-e-way, your existing BattG registration will be automatically continued unless you explicitly object to this process.
