New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Extended Producer Responsibility in Denmark

The implementation of extended producer responsibility for packaging in Denmark has been postponed until July 1, 2025. The mandatory registration of packaging that is expected to be placed on the market has also been postponed. The registration obligation will therefore no longer apply from 1 January 2024, but from 1 April 2024.

The way producer responsibility for packaging is handled in the member states of the EU is to be harmonized. The Packaging Regulation is currently still being negotiated at EU level and causes a standstill of the extended producer responsibility for packaging in Denmark, which was planned until May 9, 2024. No Danish legislation can be drafted until the EU regulation, on which national law must be based, has entered into force. As a result, the initial schedule for the implementation of extended producer responsibility for packaging will be very difficult to meet, which is why the implementation date in Denmark is now postponed to July 1, 2025.

However, there is no doubt that extended producer responsibility for packaging will be adopted, even if the timetable for implementation is further delayed. What we know so far is that packaging producers can join a collective system that fulfils your take-back obligations in Denmark and that an Authorized Representative (AR) must be appointed. According to the draft of the first part of the Danish Packaging Ordinance, both Danish companies and distance sellers are obliged to register and report.
