ElektroG licence alone is not sufficient

Despite the fact that producers already license registered brands with corresponding labels, the German Environment Agency views this model as inadequate. The deciding factor being that the devices do not originate directly from the producer. Consequently, producers must also register their brand with the EAR Foundation (German registration board for electronic equipment and batteries).

Registration required – even for small packaging quantities

Starting 12 August 2026, producers who sell less than 300 kg of packaging in Belgium or less than 50 tonnes of packaging in the Netherlands will also be required to register their company and report the packaging they sell.

OfH required for all batteries

By 15 January 2026 at the latest, battery producers must participate in a producer responsibility organisation (PRO resp. OfH – “Organisation für Herstellerverantwortung”). The EAR Foundation (German registration board for electronic equipment and batteries) must be provided with proof of participation in an OfH for all battery categories, otherwise their registration with the EAR will be revoked.
