New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Important for producers and distributors of lamps: The Foundation EAR adapts the administrative practice to lamps by January 1st, 2013 to the technical developments

The present regulation that an average weight of 120 grams is taken as basis for the calculation of the guarantee amount will be replaced from January 1st, 2013 on by applying the real weight.

According to the current press release of the Foundation Elektro-Altgeräte Register (EAR) (=German national clearing house) the present administration practice for producers of lamps will be reorganized by January 1st, 2013.

The present regulation that an average weight of 120 grams is taken as basis for the calculation of the guarantee amount will be replaced from January 1st 2013 on by applying the real weight. This real weight is also applied as calculation basis for the disposal algorithm. The time-consuming indication of the number of pieces will thus be omitted. This development takes account of the increased use of LED lamps which are regarded as particularly environmentally friendly (no mercury).

Since the LED lamps mostly have a low individual weight, the prices will be reduced while handling this kind of lamps according to the Electrical and Electronic Equipment Act (ElektroG). Furthermore, this regulation will take over the weight-related systematics of handling all other types of devices.

take-e-way welcomes this new administrative practice since it reflects the latest technical developments. Moreover, this new regulation supports the demand of take-e-way that the already dominant market position of the producers organized under Lightcycle will no longer be confirmed.
