New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Packaging Act: Starting in June 2022, marketplaces will be able to check LUCID registration automatically

The marketplaces will be directly subject to this obligation as of 1 July 2022. They are required to check whether the online retailers or sellers who offer their packaged goods on their platform have implemented the registration requirements and system participation. If the traders violate the statutory provisions, the marketplaces may no longer allow them to distribute their goods.

France: Extension of deadline for labelling of packaging

The general deadline for implementing the labeling, which concerns the packaging elements, remains 9th September 2022. However, the deadline for implementing the labelling on all packaging produced or imported before 9th September 2022 has been extended from 9th March 2023 to 15th June 2023 for producers serving one additonal waste stream (WEEE or batteries). For producers only serving the packaging waste stream the deadline will be 9th March 2023 regarding packaging produced or imported before 9th September 2022.

Packaging Act: As of 1 July 2022, Amazon merchants must self-report FBA packages
