New registration obligation for packaging in Spain

The Spanish packaging law obliges producers to register their packaging. Distributors from abroad must also register through an authorised representative if they sell packaged products in Spain.

Registration of transport packaging

From 1 July 2022 onwards, producers of transport packaging must also be registered in the LUCID packaging register.

For the purposes of the German Packaging Act, the producer of transport packaging is the distributor who first puts the packaging on the market commercially. Also considered as producers are those who commercially introduce the packaging into Germany.

This registration must be carried out directly by the companies bound by the Packaging Act and the contracting of a third party is not permitted according to Sect. 35 (1) Sentence 2 of the German Packaging Act.
